In a recent decision the German Federal Court of Justice (Bundesgerichtshof (BGH)) decided that the so-called ‘narrow most favored nation (MFN) clause’ of Booking.com violates antitrust law. According to the court, the narrow MFN clause restricts competition when offering hotel rooms (BGH, decision of 18 May 2021, KVR 54/20).
